Privacy policy (FADP)

1. Introduction

Your privacy matters to us. We process your personal data transparently, for specific purposes and proportionately, as the nDSG requires. This happens only within our comparison service for mobile and internet plans and our other guides in Switzerland.

2. Controller

The party responsible for data processing is:

3. What data we process

We process only data that is needed to run the website:

• Technical data (IP address, browser type, device, pages viewed, date and time of access) for statistical and security purposes.
• Contact details (email address, first name, message) if you fill in a form or write to us.
• Details of clicks on partner offers, where necessary for forwarding and billing.

We do not process particularly sensitive personal data (e.g. data on health, religion or origin).

4. Purposes of processing

We process your data exclusively for the following purposes:

• Providing and improving the plan comparison.
• Analysing website traffic and performance.
• Answering your enquiries.
• Ensuring the technical operation and security of the website (troubleshooting, preventing misuse) as well as serving and billing advertising and affiliate offers.

5. Basis of processing

We process personal data in line with the principles of the nDSG (lawfulness, good faith, proportionality, purpose limitation, transparency). In particular, we rely on:

• your consent, when you use a form or accept non-essential cookies via the consent banner. You can withdraw consent you have given at any time with effect for the future.
• our overriding legitimate interest in running the website securely, reliably and in an economically viable way.

If you are in the European Union and the GDPR applies, its provisions apply in addition.

6. Cookies and analytics tools

BesteAbos.ch uses:

• Google Analytics 4 (with IP anonymisation) to measure website performance.
• Functional cookies for the correct display of pages.
• Advertising and tracking cookies from our affiliate partners (e.g. Awin, Adtraction).

On your first visit, the consent banner informs you about the use of cookies. You can decline non-essential cookies there. You can also block or delete cookies at any time in your browser settings. Some website functions may then be restricted.

6a. Contact form and email delivery

When you use the contact form, we process your name, your email address and the content of your message in order to answer your request. To protect against misuse and spam, we also store the time of the message and an encrypted short value (hash) of your IP address. The IP address cannot be read directly from this value.

Your message is stored in our database (Supabase) and delivered to our mailbox through the email service Resend. The website is hosted by Vercel. These providers process data on our behalf and may be located outside Switzerland (for example in the USA). In that case we ensure adequate data protection, for example through an adequacy decision or standard contractual clauses.

We keep contact requests for 12 months at most, unless longer storage is required by law or the request concerns an ongoing matter. Using the form is voluntary. Without your details, however, we cannot reply to you.

7. Disclosure to third parties and transfers abroad

We do not sell or rent personal data.

We may pass certain data to our affiliate partners and service providers where this is necessary for forwarding you to a provider, for billing or for running the website, for example when you click on an offer.

Some of these recipients, such as Google (Google Analytics) or affiliate networks, are located abroad, including outside Switzerland and the European Economic Area (e.g. USA). In that case we ensure that adequate data protection is guaranteed, for example through an adequacy decision of the Federal Council or standard contractual clauses under the nDSG.

Our partners are themselves responsible for complying with the applicable data protection law (nDSG or GDPR).

8. Data storage, hosting and data security

The website is hosted by Infomaniak Network SA in Switzerland. We take appropriate technical and organisational measures to protect your data (SSL/TLS encryption, firewalls, regular updates). However, we cannot guarantee absolute security of data transmission over the internet.

9. Your rights under the nDSG

Under the nDSG you have, in particular, the following rights:

• The right to access the personal data we process about you.
• The right to have inaccurate data corrected.
• The right to have your data deleted or destroyed, unless statutory retention obligations or overriding interests prevent this.
• The right to object to certain processing and to withdraw consent.
• The right to receive or transfer your data in a common electronic format, where the legal requirements are met.

To exercise your rights, a request via our contact page is enough. To identify you, we may ask for proof of identity. If you believe we are not processing your data lawfully, you can contact the Federal Data Protection and Information Commissioner (FDPIC, EDÖB).

10. Retention period

We keep personal data only for as long as is necessary for the purpose concerned, or until you request its deletion, provided there are no statutory retention obligations.

11. Changes to this privacy policy

We may amend this privacy policy at any time, in particular if the law or the website changes.
